Badgers and their setts are fully protected under the Protection of Badgers Act 1992, which amended and incorporated previous legislation. A badger sett is defined in the Act as any structure or place which displays signs indicating current use by a badger. Although a sett may be empty at a certain time it may be used as part of a regular cycle throughout the year, and may therefore be considered to be in use. Development work which directly affects a badger sett will usually require a licence from Natural England.
The team can offer advice on mitigation, timing and appropriate working methods and if necessary we can secure licences in respect of development which will affect badgers. Badger gates can be supplied and fitted as part of a licensed Method Statement if necessary. As a licence from Natural England can take around 4 weeks it is recommended for surveys to be carried out early.
Our experienced surveyors can undertake initial surveys for badgers and also, if necessary, more detailed surveys which identify territories and badger social groups. Recommendations for mitigation and the requirement for a licence can be provided if required.
